RV123, Inc. GARMIN® nüvi® 3490LMT Promotional Drawing Terms and Conditions
Introduction:
These terms and conditions describe the participation requirements for the RV123,
Inc. GARMIN® nüvi® 3490LMT product Drawing (Drawing) and its general policies. RV123, Inc.
(RV123) is solely responsible for the administration of this Drawing. The owners
of trademarked names and merchandise used in this promotion do not sponsor and have
not endorsed this promotion, nor are they affiliated with RV123 in any way. All
trademarks are the property of their respective owners with all rights reserved.
To enter in the drawing, you must be at least 18 years old and a legal resident
of the United States with a valid e-mail and mailing address (PO Boxes are not acceptable).
Offer not valid to residents where prohibited by law.
How it Works:
Participants must be at least 18 years of age. To be entered in the drawing for
the GARMIN® nüvi® 3490LMT, you must:
1) Sign up as an RV123 Community Member by completing this online registration form
with valid, accurate and required information. This will provide you with 5
entries. One registration per person. Multiple online registrations do NOT increase
your chance of winning and entrants submitting multiple registrations will be disqualified
from the drawing. Please understand that failure to supply current and accurate
address and contact information on the entry registration form may hinder our ability
to deliver the gift to you.
2) After performing Action 1, “Like” RV123 on Facebook. This will provide you with
5 additional entries. You must perform Action 1 in order to be eligible for Action
2 entries.
Performing both actions will provide you with a total of 10 drawing entries.
Any and all Drawing entries must be submitted by February 29th at 11:59pm EST. After
the close of Drawing registration, RV123 will hold a drawing for one (1) winner
who will receive a free GARMIN® nüvi® 3490LMT.
Promotional Gift
GARMIN® nüvi® 3490LMT (Approximate Retail Value is US$400.00) From time
to time the manufacturer may change the specifications of the promotional gift and
RV123 reserves the right to change to comparable products at the sole discretion
of RV123. Any costs or expenses associated with the acceptance and use of any Contest
Prizes are the sole responsibility of the recipient. RV123 is not responsible for
any damages or injury incurred by any Participant as a result of winning. "GARMIN® nüvi® 3490LMT"
is a trademark of Garmin, registered in the U.S. and other countries.
Odds of Winning
NO PURCHASE NECESSARY TO ENTER OR WIN. Odds of winning depend on the number of eligible
entries received. Entry is open to residents of the contiguous United States aged
18+. Void where prohibited.
Eligibility
Employees of RV123, their affiliates, parent companies, participating vendors, subsidiaries
and advertising and promotion agencies, and anyone working directly on this program,
product and promotion and the immediate family members or those living in the same
household of each are not eligible to participate.
Participation Period
The Promotion begins on February 1, 2012 and ends on February 29, 2012 at 11:59pm.
Winner Notification
The Winner will be notified by phone or e-mail of the drawing. Winners
may be required to provide RV123 with an Affidavit of Eligibility/Liability/Publicity
release and IRS tax form W-9 or IRS tax form W8-BEN. If winner does not reply to
such notification, the notification is undeliverable, and/or the forms are not completed
and returned within 10 days of prize notification, the winner may be disqualified
and an alternate winner will be selected based upon a new random drawing. The GARMIN® nüvi® 3490LMT
will be mailed within approximately 14 days of receipt of completed/signed documents.
Conditions of Participation
This Drawing is void where it is restricted or prohibited by law. Submission of
an entry and/or acceptance of a prize constitutes permission for RV123 to use that
entrant's name, likeness, picture and Entry for promoting RV123 products without
additional compensation unless and where prohibited by law. By participating in
this Drawing you agree to and hereby release and hold harmless RV123 from any and
all liability or any injuries, loss or damage of any kind arising from or in connection
with this Drawing, use or license of your Entry, or any prize. If you do not want
to grant the foregoing release, please do not participate in the Drawing. By submitting
your Entry in the Drawing, you represent and warrant that you have obtained any
and all consents, model releases, approvals or licenses required for you to submit
your Entry and comply with all of these Terms and Conditions, including obtaining
the written consent of all 3rd parties, where applicable.
Rules Amendment and Interpretation
The Drawing and its continuing terms and conditions, benefits and participation
are offered to Participants at the sole discretion of RV123. RV123 reserves the
right to amend or interpret the Terms and Conditions or official Drawing communications
and any element or elements arising under or relating to the Drawing at any time,
upon published notice to participants on RV123's website (the Site) or at an RV123 tradeshow
booth. A participant shall be deemed to have notice of any
such amendments or interpretations upon publication of the same on the Site or at
the booth and shall be deemed to have accepted such amendments or interpretations
by virtue of a participant's continuing participation in the Drawing. Should a participant
not wish to continue to participate in the Drawing pursuant to the prevailing Terms
and Conditions, as amended or interpreted, a participant may terminate participation
in the Drawing by notifying RV123.
Terms:
RV123 is not responsible for the performance, maintenance or support of any promotional
products or gifts nor transactions that you enter into with the manufacturers, advertisers,
sponsors, or partners of these promotional products. RV123 cannot fulfill any service
or support agreements for the promotional products on your behalf, refund any charges
you have incurred, or service an account you created with the manufacturer or reseller
of the promotional products. You should carefully read the requirements, terms and
conditions, privacy policy, and billing practices for the promotional product and
gift at the manufacturer’s website. The RV123 GARMIN® nüvi® 3490LMT is only available to valid
registrants meeting the terms and conditions of this promotion. In case of a dispute
as to the identity of an entrant using the internet, the authorized account holder
of the e-mail address used to enter the Promotion at the time of entry will be considered
the entrant. All fields must be filled out completely and truthfully. Failure to
complete the entire entry form may result in disqualification from the contest.
RV123.com is not responsible for any problems with your entry, including technical
failures related to computer, telephone, cable, and unavailable network or server
connections, or other failures related to hardware, software or virus, or incomplete,
late, or misdirected entries. RV123.com reserves the right to disqualify any person
tampering with the operation or conduct of the Promotion, including, without limitation,
the entry process or operation of the website or otherwise violating these rules.
If product is returned, then any financial credit for the product will not be awarded.
RV123 will only send promotional gifts to the address and name of the winning registrant
used during registration. RV123 is not liable for errors in shipping or receiving
and once RV123 has sent the product to the winner, all risk of loss transfers to
the winner. Upon delivery of the promotional gift to the winner’s address, a delivery
confirmation signature will be required. Once the signature is provided (by any
person or persons at the address of the subscriber), RV123 will deem this to be
proof of delivery.
All entries (including non-winning entries) become the property of RV123 and will
not be returned. As a condition of submitting your entry and/or accepting a prize,
you agree to grant RV123 an irrevocable and perpetual royalty-free worldwide license
to use, reproduce, publish, alter, display and/or copyright your name, likeness,
biographical information and/or photograph, in print and on the web for the non-exclusive
benefit of RV123.
RV123 reserves the right to cancel, terminate or modify the Promotion if it cannot
be operated, conducted, or completed as planned for any reason. UNDER NO CIRCUMSTANCES
SHALL RV123 BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY
DAMAGES, ATTORNEYS’ FEES, OR ANY OTHER DAMAGES as a result of any modifications
or termination of the Promotion.
This Drawing is governed by Florida law, and by participating you agree to accept
jurisdiction and venue in the Courts of Seminole County in the State of Florida,
U.S.A.
Privacy:
Registering for this drawing will automatically add you to our promotional e-mail
list, which we use for the purpose of sending information about RV123 & industry
products, services, and community. You may unsubscribe or adjust your subscription
options at any time.
Tax Liability:
You are responsible for all local, state, and federal taxes on any promotional gifts
you receive. You also agree to provide any required information necessary to satisfy
taxing authorities and to allow RV123 to prepare and submit any required documentation
related thereto prior to the award of the prize.
Liability Release:
By participating in any RV123 promotion, you release RV123 and its respective parents,
subsidiaries, and other affiliated companies, and the directors, shareholders, officers,
employees, or agencies of any of the above organizations, for any and all liability
for any injury, death, loss, tax liability or damage of any kind arising from entrant’s
participation in this program, or resulting from acceptance, possession, use or
misuse of any promotional offer or gift. Failure to comply with these Terms and
Conditions may result in disqualification.
RV123 is not responsible for any incorrect or inaccurate information, whether caused
by any of the equipment or programming associated with or utilized in the Drawing
or by any technical or human error which may occur in the processing of Entries.
RV123 assumes no responsibility for any error, omission, interruption, deletion,
defect, delay in operation or transmission, communications line failure, theft or
destruction or unauthorized access to, or alteration of, entries. RV123 is not responsible
for any problems or technical malfunction of any telephone network or lines, computer
on-line-systems, servers or providers, computer equipment, software, failure of
e-mail on account of technical problems or traffic congestion on the Internet or
at any website or combination thereof, including injury or damage to participants
or to any other person's computer related to or resulting from participating or
downloading materials in this Drawing. If, for any reason, the Drawing is not capable
of running as planned, including infection by computer virus, bugs, tampering, unauthorized
intervention, fraud, technical failures, or any other causes beyond the control
of RV123, which corrupt or affect the administration, security, fairness, integrity
or proper conduct of this Drawing, RV123 reserves the right at its sole discretion
to cancel, terminate, modify or suspend the Drawing. Apple, Inc. is not a sponsor
of the Drawing and has no responsibility or liability regarding the conduct or administration
of the Drawing.
By participating in the Drawing, you agree to release and hold harmless RV123 and
its employees, officers, affiliates, agents, and advertising and promotional agencies
from any and all damages, injuries, claims, causes of actions, or losses of any
kind resulting from your participation in this Drawing, including infringement of
intellectual property rights. RV123 and its employees, officers, affiliates, agents,
and advertising and promotional agencies assume no responsibility or liability for
any damages, injuries, claims, causes of actions, or losses of any kind arising
in whole or in part from this Drawing.
DISCLAIMER OF WARRANTIES:
THE GIFT YOU RECEIVE FROM US IS PROVIDED TO YOU ON AN “AS IS” AND “AS AVAILABLE”
BASIS AND ALL WARRANTIES, EXPRESS AND IMPLIED, ARE DISCLAIMED TO THE FULLEST EXTENT
PERMISSIBLE PUSUANT TO APPLICABLE LAW (INCLUDING, BUT NOT LIMITED TO, THE DISCLAIMER
OF ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF INTELLECTUAL PROPERTY
AND/OR FITNESS FOR A PARTICULAR PURPOSE). IN PARTICULAR, BUT NOT AS A LIMITATION
THEREOF, COMPANY MAKES NO WARRANTY THAT THE GIFT WILL MEET YOUR REQUIREMENTS AND/OR
THAT ANY THIRD PARTY PARTNER WILL PERFORM ITS ASSOCIATED OBLIGATIONS IN A TIMELY
OR SATISFACTORY MANNER.
Acceptance:
If you do not accept any of the terms of this Policy, we ask that you not complete
our registration process. Your registration and entry into the Drawing with RV123
constitutes your acceptance of these terms and conditions.
